Our terms and conditions
1 General
The following terms and conditions of sale and delivery apply exclusively to online business transactions between AkkuShop-Schweiz.ch and the customer. Any agreements to the contrary must be confirmed in writing by both parties. By placing an order, the customer expressly accepts the terms and conditions of Akkushop-Schweiz.ch. Akkushop-Schweiz.ch is entitled to change or supplement these terms and conditions of sale and delivery, including any information, at any time, with immediate effect. Orders received previously will be processed according to the old terms and conditions of sale and delivery. The customer's contractual partner is Akkushop-Schweiz GmbH, which is referred to as Akkushop-Schweiz.ch in the Terms and Conditions.
2 Prices
All prices are in Swiss francs. We reserve the right to adjust our selling prices in the event of manufacturer price changes. All prices include VAT and the recycling fee (vRG).
3 Offer and Conclusion of Contract
The presentation of the products [in the online shop] does not constitute a legally binding offer, but rather an invitation to the customer to place a binding order (offer to conclude a contract).
By clicking the order button, the customer places a binding order for the products listed on the order page.
Immediately after receiving the order, the seller will confirm receipt of the order by email. The purchase contract is only concluded when the seller confirms shipment of the goods by email (order or shipping confirmation) or, at the latest, upon delivery of the goods.
4 Delivery
We deliver within Switzerland and Liechtenstein to private or business addresses. PO boxes or military training schools cannot be delivered.
The items offered in the AkkuShop-Schweiz.ch online shop will be confirmed by email upon receipt of your order and assigned an order number. Your order will be shipped after receipt of your order or payment.
We reserve the right to supply equivalent replacement items. In all cases, we are not liable for delivery delays caused by the manufacturer or our supplier.
The customer's delivery address must be in Switzerland or Liechtenstein and easily accessible by car. If this is not the case, or if the customer has provided an incorrect or incomplete address, the customer will bear any resulting costs.
The customer is responsible for ensuring that access to the specified delivery address is possible and guaranteed. The customer must check whether the product fits through the access points (e.g., stairwells, doors, mailboxes, etc.). If the product cannot be transported to the delivery address, the customer will bear any additional costs.
If the customer does not accept the ordered products at the agreed delivery address, they will be deposited on-site by the freight forwarder.
Partial deliveries will be sent if certain products are backordered for a longer period. If partial deliveries are urgently needed, they can also be initiated at the customer's request. To do so, use our Digital Assistant, which can also be accessed via our shops, or contact us via the contact form.
4.1 Delivery Costs
We deliver letters and parcels under 10kg for a flat rate of CHF 9.50 including packaging costs.
For deliveries from 10kg to 20kg, the flat rate is CHF 14.50, and for deliveries from 20kg to 30kg, the flat rate is CHF 29.00.
Special arrangements are possible upon request, e.g., for larger order quantities or for bulk orders.
For e-bike batteries, a charge of CHF 35 per battery and delivery applies due to the necessary transport of hazardous goods.
4.2 Delivery times:
The delivery time is specified for each item in the shopping cart.
Generally, the following applies:
Items in stock in Switzerland can be delivered within 1-2 business days.
Many items are also stored in our main warehouse in Korb DE. If this is the case, the delivery time is normally 6-8 business days.
For some less common products and specialty batteries, the delivery time may be longer. All information regarding delivery times is based on experience and is non-binding!
If Akkushop-Schweiz.ch is in default of delivery, the customer has the right to withdraw from the contract starting 30 calendar days after the originally announced delivery date. In this case, Akkushop-Schweiz.ch will refund any amounts already paid in advance. No further claims against Akkushop-Schweiz.ch exist.

4.3 Local Pickup:
We do not offer local pickup. Please order directly from our shop AkkuShop-Schweiz.ch
Our shipping companies will deliver the goods quickly and easily.

5 Payment Methods
The following payment options are available to customers: invoice, advance payment, Twint, PayPal, credit cards, Postfinance Card, Postfinance E-Payment and ApplePay.
Fees charged by credit institutions are borne by Akkushop-Schweiz.ch. There are no additional costs for you.

Our invoices are due within 30 days of the delivery date without any deductions. In case of non-compliance with this payment deadline, we are entitled to charge default interest of 6% and a processing fee of CHF 16.50. We also reserve the right to process orders from new and existing customers against advance payment. Akkushop-Schweiz.ch may conduct a credit check during the ordering process with the assistance of Intrum AG.

5.1 Default of Payment
If the customer fails to meet their payment obligations in whole or in part, all outstanding amounts owed by the customer to Akkushop-Schweiz.ch under any title will become due immediately (for advance payments within 8 calendar days of the first reminder). Akkushop-Schweiz.ch may immediately demand payment and stop further deliveries of products to customers.
Akkushop-Schweiz.ch charges a handling fee of CHF 16.50 for the second reminder.
If reminders are unsuccessful, the invoice amounts may be assigned to a debt collection agency. Intrum AG, the company commissioned by Akkushop-Schweiz.ch to collect the debt, will claim the outstanding amounts in its own name and for its own account and may charge additional processing fees.

5.2 Retention of Title
For delivery against invoice, the delivered goods remain the property of Akkushop-Schweiz.ch until full payment has been made.
6 Technical Information
We are not the manufacturer of the products we offer. All technical information, data, and dimensions are based on the manufacturer's specifications and do not constitute any warranty on our part for specific properties. No liability is assumed for transmission and printing errors.
7 Cancellation and Return Conditions
Complaints and notices of defects must be submitted within 14 days using a return slip; otherwise, the delivery will be deemed accepted.

The invoice date and the postmark of the return shipment are decisive for compliance with the deadline. Otherwise, the deadlines according to Section 7.2 apply.
In addition, the following conditions apply: All items must be returned with a fully completed return slip, in new condition, and in the undamaged original packaging. All items must be complete and functional.
Failure to comply with these requirements may result in a corresponding deduction or refusal of acceptance.
The customer shall bear any shipping costs incurred.
7.1 Changes to Orders or Cancellations
Orders oblige the customer to accept the products and services. Akkushop-Schweiz.ch may accept subsequent changes or cancellations of orders at its sole discretion and charge a handling fee of 20% of the canceled order value, but at least CHF 20, as well as any loss of value of the canceled products since the order was placed.
If a (partial) delivery impossibility (condition subsequent) occurs after the order has been placed or the contract has been concluded, the customer will be informed immediately by email. If the customer has already paid, this amount will be refunded. If no payment has been made, the customer is released from the obligation to pay. Further claims due to delayed or non-delivery delivery are excluded.
7.2 Parcel shipment by freight forwarders
The deadline for reporting non-received parcels is 14 days and can be submitted via the Akkushop-Schweiz.ch contact form or by email. Transport damage must be reported to the freight forwarder within 7 days. Otherwise, the shipping insurance will be voided, and the goods cannot be reimbursed.
7.3 Transfer of Risk
The risk is transferred to the buyer upon dispatch of the goods by AkkuShop-Schweiz.ch.
8 Warranty
Die Garantie beträgt 1 Jahr, falls in den Verkaufsunterlagen nichts anderes vermerkt ist. Für E-Bike Vision Akkus beträgt die Garantiezeit 2 Jahre.
Sie beginnt ab dem Lieferdatum. Die Faktura gilt als "Garantieschein". Bei Garantieansprüchen ist das defekte Material inkl. Retourenschein mit der Fehlerbeschreibung und Rechnungskopie an uns einzusenden.
Von der Garantie ausgeschlossen sind Schäden, die auf eine der folgenden Ursachen zurückzuführen sind:
- unsachgemässe, vertragswidrige oder wiederrechtliche Lagerung, Einstellung oder Benutzung der Produkte;
- Einsatz inkompatibler Ersatzteile- oder Zubehörteile (z.B. Stromversorgung);
- Unterlassene Wartung und/oder unsachgemässe Abänderung oder Reparatur der Produkte durch die Kundschaft oder einen Dritten;
- Höhere Gewalt, insbesondere Elementar-, Feuchtigkeit-, Sturz- und Schlagschäden usw., welche nicht durch Akkushop-Schweiz zu vertreten sind, und behördliche Anordnungen.
Verschleissteile wie insbesondere Batterien, Akkus, Kabel, Adapter und Leuchtmittel sind von der Garantie ausgenommen.
9 Weitere Bestimmungen
9.1 Nicht zuzuordnende Rücksendungen
Rücksendungen, die Keiner Kundschaft zugeordnet werden können, werden zwei Monate von Akkushop-Schweiz.ch aufbewahrt und dann fachgerecht entsorgt.
9.2 Liability
The customer is responsible for the selection and use of the products. Claims for damages of any kind are excluded unless we are intentionally responsible for the damage. We are not liable under any circumstances for consequential or indirect damages.
9.3 Data Storage
In accordance with data protection law, we would like to point out that the data required for business transactions is processed and stored using an IT system. Personal data will, of course, be treated confidentially.
9.4 Partial Invalidity
Should individual provisions of these Terms and Conditions be invalid or ineffective, this shall have no effect on the validity of the remaining provisions and these Terms and Conditions as a whole.
9.5 Place of Jurisdiction
Our business activities are based exclusively on Swiss law. Place of performance and jurisdiction is Zurich. Should there be any discrepancies in the translation of languages in the shop, e.g. in the terms and conditions or similar, the German version shall always be authoritative.
